Nintendo has taken legal action against accessory manufacturer Genki and its parent company Human Things for displaying unauthorized 3D-printed mockups of the upcoming Nintendo Switch 2 console months before its official announcement.
The lawsuit, filed in California, accuses Genki of trademark infringement, unfair competition, and false advertising after the company showcased what it claimed were accurate representations of Nintendo's next gaming system at the Computer Electronics Show (CES) 2025.
According to court documents, Genki CEO Edward Tsai and other company representatives conducted media interviews discussing specific details about the unannounced console and showed off physical mockups, claiming they were based on an authentic Nintendo Switch 2 device.
The timeline of events outlined in Nintendo's lawsuit began in December 2024 when Genki publicly discussed Switch 2 accessories on social media. The situation escalated at CES 2025, where Genki displayed promotional videos featuring unauthorized Nintendo Switch 2 logos and renderings.
Nintendo alleges that Genki continued to mislead consumers even after being approached by Nintendo's legal team at CES. The accessory maker later held its own "Direct" presentation - mimicking Nintendo's branded announcement format - one day before Nintendo's official Switch 2 reveal.
If successful, the lawsuit would require Genki to:
- Destroy all products related to Nintendo Switch and Switch 2
- Cease using Nintendo trademarks
- Pay damages for infringement and false advertising
Human Things has 30 days to respond to the allegations. The Nintendo Switch 2 is scheduled for release on June 5.
